where this option is made available to you by Shethiya Telecom in the user interface for any service; or by actually using the services. In this case, you understand and agree that Shethiya Telecom will treat your use of the services as acceptance of the terms from that point onwards.

You may not use the services and may not accept the terms if,

    • you are not of legal age to form a binding contract with Shethiya Telecom, or
    • you are a person barred from receiving the services under the laws of India.

    • In case the product of your choice is not in stock in the nearest location to your pin code, the delivery time might be increased, but we will make sure the product reaches your doorstep at the earliest. shipping done withing 7 to 10 Days

SHETHIYA are our trademarks and service marks. All other trademarks, product names, company names, and logos appearing on the site are the property of their respective owners.

 

  • Submissions:
    • If you submit, post or otherwise send us any information, content, or materials including, without limitation, comments, reviews, data, text, messages, files, images, photographs, videos, audiovisual works, other persons' names, likenesses, voices, usernames, profiles, actions, appearances, performances and/or other biographical information or material, and any other materials, as well as links to data, text, files, images, photographs, videos, audiovisual works, shall be entitled to unrestricted use of such submissions for any purpose at all, commercial or otherwise, without the requirement of any further permission from or payment to you or any other person or entity, including without limitation for inclusion in any future gale publication or gale product, with no compensation to you.
    • No submission shall be subject to any obligation of confidentiality on our part, and we shall not be liable for any use or disclosure of any submission. Without limiting the previous, you hereby grant us.

 

 

  •  Payment and billing:

You must select a payment method to pay us for any purchases you make from us. Every time you use the service, you reaffirm that

 

  • We or our authorized billing agents are authorized to charge your designated payment method.
  • We may submit charges incurred under your account for payment, and you will be responsible for such charges, even if your membership is cancelled or terminated. You agree that we may charge your payment method for all amounts due to us without additional notice or consent unless required otherwise by law.
  • You are responsible for all charges incurred under your account made by you or anyone who uses your account (including your children, family, or friends).
  • We may, at our discretion, post charges to your payment method individually or may aggregate your charges with other purchases you make on the site and apply those charges to your next billing cycle. All purchases for mobile, services, accessories, and all subscriptions are final and non-refundable.
  • You must notify us about any billing problems or discrepancies within 5 days after they first appear on the statement you receive from your bank or Credit Card Company.
  • If you do not bring such problems or discrepancies to our attention within 5 days, you agree that you waive the right to dispute such problems or discrepancies.
  • In case of Order cancellation, the mode of payment will be done by transferring through NEFT. Or Payment Gateway (i.e. we can't offer your payment as cash)

 Proof of identification:

Shethiya Telecom reserves the right to ask for defined proof of identification at the time of delivery. Failure to provide the same to either Shethiya Telecom or any of its associates can lead to cancellation of the order. In case of any gift items, the customer who has made the transaction online will have to provide his/her proof of identification.

 

  • Limitation of liability:

You hereby agree to fully indemnify, defend, and hold our company and its parent and affiliates and their respective officers, directors, employees, and licensors harmless from and against any claims, liability, losses, costs, and expenses (including attorneys' fees) incurred by you in connection with

    • Any use or alleged use of Shethiya Telecom/services through your account by any person, whether or not authorized by you;
    • The operation and content on your site or
    • Any breach of your representations and warranties and other covenants under this agreement

Shethiya Telecom reserves the right, at its own expense, to assume the exclusive definition and control of any matter otherwise subject to indemnification by you, and in such case, and agree to cooperate with Shethiya Telecom definition of such claim.

Under no circumstances and no legal theory, tort, contract, strict liability, or otherwise, shall the mobile store(s)/content producer or Shethiya Telecom be liable to you or any other person for any indirect, special, incidental, or consequential damages of any character including, without limitation, damages for lost profits, loss of goodwill, work stoppage, the accuracy of services, content or results, computer failure or malfunction, damages resulting from disabling of the services provided as part of the mobile store(s)?

 

  • Applicable taxes:

Unless otherwise stated, all prices exclude value-added tax (VAT) / central sales tax and service tax as applicable in India.

 

  • Warranty:

Mobile handsets & chargers are warranted for a period defined by the respective manufacturer’s agents' defect in material & workmanship. Shethiya Telecom does not give a warranty and does not hold out any warranty on products sold.

Shethiya Telecom will not be responsible for any defective/deficient or otherwise unsatisfactory products any such defective or deficient goods have to be repaired only by the authorized service centre of the equipment manufacturer.

All the terms and conditions of Shethiya Telecom apply, subject to Bangalore jurisdiction. Goods once sold cannot be returned or exchanged.

 

  • Governing law and jurisdiction:

These terms and conditions shall be governed by and construed by the law of India and any legal discrepancy or disputes will be heard or proceed in the exclusive jurisdiction of the Indian courts at Bangalore, (Karnataka) India.

 

  • NO Cost EMI / Low-Cost EMI:

How does Cost EMI work?

    • On completion of the purchase of your favourite product with No Cost EMI - your credit card will be initially blocked for the full purchase amount.
    • This will be converted into EMI by the bank in the next 4-7 working days.
    • You will get an instant discount equal to the interest payable at the time of order, i.e., the interest charged by the bank will be offered as an upfront discount, effectively making it No interest.
    • You will pay exactly the price of the product only and no extra costs about interest or processing fees.
    • Low-cost EMI charge maybe different, bank card wise

 

 

    • Cancellation Policy:
  • Cancellation of order only until the pickup of the product by the delivery person/Courier as the case may be. 
  • In case of customer-initiated cancellations, for prepaid orders, before shipment, a 2% cancellation charge may be levied to recover payment gateway charges.
  • Cancellations requested post-dispatch & cancellations due to bulk ordering of the product may be charged 2.5% or INR 500, whichever is higher to recover the cost of the payment gateway and less.
  • Cancellation may be requested by calling customer care or writing to support 
  • In case of courier delivery & cancellation, refund of money after a parcel is received at Origin and deduction of handling charges
  • Shethiya Telecom reserves all rights, without any prejudice. 
  • Shethiya Telecom requires and recommends that an Unboxing Video may be captured from the point of product delivery to unwrapping, should there be damage claims later. The video is to be shared with the Sangeetha support team within 48 hours of the delivery of the product.
  • Shethiya Telecom deserves the right to cancel the order as per the Fair Usage Policy

 

 

 

CANCELLATION AND RETURN POLICY

 

 General

 We aim to provide the best customer experience to our   Users beginning from placing an order to initiating a   return. While transacting on the Shethiya Telecom   Platform, you can expect a hassle-free experience in   returning the Product that you have ordered and can rely   on us as your preferred shopping destination.

 This cancellation, replacement, return and refund policy   (“Policy”), together with the Terms sets out our   procedures and policies in accepting Product   cancellation,  replacement, return and refund thereof.

 

 Applicability of Policy

 By agreeing to use Shethiya Telecom Platform and/or   initiating a request for purchase of Product(s) on the   Shethiya Telecom Platform, you agree to be bound by   the terms contained in this Policy without modification. If  you do not agree to the terms contained in this Policy,   you are advised not to transact on the Shethiya Telecom Platform.

Please note that we may from time to time change the terms of the Policy that govern your cancellation, replacement, return and refund of an order for Products on Shethiya Telecom Platform.

 

 Cancellation of Products

Orders cannot be cancelled once the package is “Out for Delivery”. You can track your order under ‘My Order’ section of your account on Platform.

On receipt of the cancellation request, we will attempt to cancel the order/shipments as long as it is not “Out for Delivery”. You will receive a confirmation as soon as the cancellation is accepted and the amount paid towards the order will be initiated in below timeline:

 

 Replacement or Exchange of Products

 You may initiate the request for replacement of the   Product within 7 days from the time the Product(s) is delivered to you (“Replacement Period”) if:

 Product is received in a physical damaged condition, to   be reported to us within 24 hours of delivery or before   activation of products like Mobiles, Tablets, Laptops, whichever is earlier.

 Product or parts of the Product or accessory is missing, to   be reported to us within 24 hours of delivery or before activation of the products like Mobiles, Tablets, Laptops, whichever is earlier.

 All our packages come with "Tamper Evident Void Seals".   Please ensure that you do not accept packages where the   seal is tampered. Acceptance of a tampered "Void Seal"   or a damaged box will automatically disqualify you from   any replacement claims for physically damaged/defective   products, incorrect product, or missing accessories.

 You shall keep the Products in its unused, original   condition, along with the original invoice/ sale receipt, brand outer box, MRP tags attached, user manual,  warranty cards, and original accessories in manufacturer   packaging for a successful replacement pick-up. We   would accept the request for replacement of such Product   subject to the terms of this Policy.

 If you have received any Product which is subject to   replacement in terms of this Policy, we suggest you to   immediately register a request in this regard on the   Shethiya Telecom Platform. We will in our sole discretion   verify if: (a) the defects and damages in the Products or   inaccuracy claimed in such Products are acceptable by us,  or (b) such defects, damages or inaccuracy are due to   our default, and will accordingly post verification, accept   or reject the request for replacement. For such   verification, we may request you to send us an unboxing video and images of the damaged, defective or inaccurate Product received with clear timestamp and/or allow our personnel to schedule a call or visit to assess   the damage, defect in the Product. Alternatively, you   could also share the Brand DOA certificate for us to   process replacement. Further to the assessment of the   damage or the concern reported in the replacement   request, we may in our sole discretion resolve the issue     subject to the assessment report, in a manner as we may   deem fit.

 Your replacement will be processed only when the   conditions as may be stipulated by us are fulfilled at the   time of replacement of such Products, such as the   Product to be replaced being provided to us in original   condition along with the price tag intact including original   packaging of the Product, the serial number/ bar code of   the Product matches our records, if Product(s) bought as   a combo then Product(s) sent for replacement to be as a   complete combo, the brand outer packaging of the   Product and all accessories therein shall be intact, no   damage having occurred post-delivery of the Product   while in your possession etc.

 You agree that we will not replace any Product: (i) if you   have placed the order for a wrong Product model, colour   or incorrect Product, (ii) if the Product belongs to non-   replacement Product category (iii) if you fail to request   replacement/register a complaint in relation to a   damaged, defective or inaccurate Product within the   Replacement Period (iv) if products like Mobiles, tablets,   laptops are found activated during investigation. Any   damage to the Product caused by your improper use of   the Product, or any modification or change to the Product   by you the User or a third party or any depreciation in   the value for other reasons will not be deem such Product   a damaged, defective or inaccurate Product and will not   be considered a quality problem. Any decision by us in   this regard shall be final and binding.

 

 Return

 You may initiate the request for return of the product   within 7 days from date of delivery (Return Period) if:

 Product ordered is different from what was ordered basis   the Product description provided on the Shethiya Telecom Platform, to be reported to us within 24 hours of   delivery or before activation of products like Mobiles,  Tablets, Laptops, whichever is earlier

 Product found defective or is not in working condition; to   be reported to us within 24 hours of delivery or before   activation of the products like Mobiles, Tablets, Laptops, whichever is earlier'.

 Product is received in physically damaged condition, to be   reported to us within 24 hours of delivery or before   activation of the products like Mobiles, Tablets, and   Laptops, whichever is earlier.

 Product or parts of the Product or accessory is missing, to   be reported to us within 24 hours of delivery or before   activation of the products like Mobiles, Tablets, Laptops, whichever is earlier.

We will in our sole   discretion verify if: (a) the defects and damages in the   Products or inaccuracy claimed in such Products are   acceptable by us, or (b) such defects, damages or   inaccuracy are due to our default, and will accordingly   post verification, accept or reject the request for return.   For such verification, we may request you to send us an unboxing video and images with clear timestamp of the damaged, defective or inaccurate Product received and/or allow our personnel to schedule a call or   visit to assess the damage, defect in the Product.   Alternatively you could also share the Brand DOA   certificate for us to process return. Further to the     assessment of the damage or the concern reported in the   return request, we may in our sole discretion resolve the   issue subject to the assessment report, in a manner as   we may deem fit.

 Your return will be processed only when the conditions as   may be stipulated by us are fulfilled at the time of return   of such Products, such as the Product being return in   original condition along with the price tag intact including   original packaging of the Product, and the serial number/   bar code of the Product matches our records, if   Product(s) bought as a combo should be returned as the   complete combo, the brand outer packaging of the   Product and all accessories therein, no damage having   occurred post-delivery of the Product while in your   possession etc.

 The below product categories are marked as ‘non-   returnable’ unless the package received is verified as   defective or damaged –Mobile Phone accessories like   screen guards, screen protectors and tempered glass.

 

 Refund

 At the time of raising a request for return or cancelling   the Products on Shethiya Telecom Platform, you may   seek refund. Such refund will be made to you only in the   event the payment has been received by us for the   Product.

 Please be informed that when you opt to cancel or return   the Products, upon our verification and assessment of the   Products and the documents relating thereto, the refund   amount for such Products which are eligible for return as   per the terms of this Policy, will be processed within 48   (forty eight) hours from the date of us receiving the   returned Product back at our warehouse. Your refund will   be processed only when the conditions as may be   stipulated by us are fulfilled, such as the Product being   returned in original condition, along with the price tag   intact including original packaging of the Product, the   brand outer packaging of the damage or defective or   inaccurate Product and all accessories therein is intact.   For the sake of abundant clarity, it is clarified that we   shall imply appropriate penalty in refund amount in   respect of a Product that is deemed ineligible for a full   refund based on our verification and assessment. The   refund amount will be credited to the original payment   mode opted by you. You acknowledge that after initiation   of refund, it may take additional time for your refund to   reflect in your account which is subject to your financial   institution or payment solution provider terms and   conditions.

 We do not make any cash refunds. The amount will be   refunded to you within 7 (seven) working days into the   original mode of payment chosen by you. Sometimes   banks or financial intermediaries take a longer time to   process the refund request. However, if the refund does   not happen by the date advised, you may contact us, and   we will gladly help you.

  Refund to be made to the User shall not include any   amount paid towards shipping charges or any other such   charges applicable from time to time. However, in the   event a Product has been delivered with a defect or   damage (for reasons attributable to and accepted by us   after due verification at its sole discretion) we may refund   the shipping charges to you. You will be provided with a   refund if you have received a non-returnable Product in a   damaged or defective condition subject to verification and   examination of the damage or defect of the Product by us.
